Debt Relief  or Debt Scam?
Like the tax scams in the 1970s, more and more supposed “debt relief” or “debt termination” companies are proliferating on the internet claiming to be able to “eliminate credit card debt legally, lawfully, and ethically” for free (besides their hefty up front fee of course). Many of these companies charge fees in excess of $3000 just to get started. In exchange, you receive a document to take to the credit card companies or circuit court in the event you are sued that completely absolves you of your responsibility to pay back what you owe.

These firms are not to be confused with debt settlement or credit counseling organizations, which negotiate to lower the amount that you owe or set you up on a favorable payment plan, respectively. With debt settlement, credit counseling, and other debt relief options the fundamental concept is that a consumer pays back the debt in a reworked fashion according to what is affordable. On the other hand, these debt termination companies claim to be able to eliminate your debt completely, and you do not even have to pay your creditor a dime. The underlying premise is difficult to understand, but in general, these debt termination companies advance the theory that you never owed the debt to begin with. Much of it rests with the idea that the Federal Reserve or the US dollar are completely illegitimate, and that the money a consumer borrows from a credit card company is actually their own money.

Needless to say, judges do not look favorably upon these cases when they do in fact appear in court, and the success rate of prosecutors who are suing these consumers in court is by all accounts high.
